Mediation Process

When an alleged breach of the Code of Practice arises but where direct negotiation between the parties fails, Members are encouraged to seek to resolve their differences by mediation, irrespective of the nature of the dispute.

Mediation is a "without prejudice", voluntary and private dispute resolution process, in which a neutral person (the mediator) helps the parties to reach a negotiated agreement. It is also as confidential as the law will allow. Mediation may occur prior to or simultaneously with Complaints Panel proceedings, arbitration or litigation.
